We strongly discourage a reserve, but may agree to one if it is well below fair market value on exceptional pieces. In the absence of a No Reserve/Absolute Auction stipulation, it is the Auctioneer's duty; in fact obligation by law to protect the Seller and reject any bid that is deemed a virtual sacrifice of the Seller's property. Therefore, in order to reach a fair wholesale price or reserve the Auctioneer may bid or start the bidding on behalf of the Seller with the Seller's knowledge and permission.

(When a No Reserve or Absolute Auction is advertised, reserves are not permitted beyond the 5.00 minimum bid required to clerk a ticket. The Auctioneer as a registered buyer and by permission of the Seller may bid also. It is our policy however that the Auctioneer bid only ONE time on any one item and that bid will usually be the starting bid and/or be well below a reasonable wholesale price . The Auctioneer may still however, exercise a right to not offer up or present one or more items or may cancel the auction if there is an insufficient number of bidders to conduct a fair auction or if the Auctioneer detects any illegal collusion or attempt by one or more bidders to fix or effect the final bid. If any item is offered for sale it will be sold to the highest bidder, regardless of price).

Collusion or any agreement made between bidders at any auction to refrain from making bids on items or to fix the amount of the winning bid is highly illegal and tantamount to the Auctioneer making up bids that do not exist. When one person agrees not to bid against another so as to allow one or the other to buy the item for less it is considered a conspiracy to commit fraud at public auction. The Auctioneer or Seller may or may not press charges, but at the very least, this practice is not fair or ethical to the Seller and anyone inciting others to do this will be asked to leave the auction.

Some of you have, are, or will be consigning items to auction and while we want our auction Buyers to get great deals, the Seller also has to feel the auction is beneficial or soon quality items will no longer be available. It is our aim at every auction to treat both Sellers and Buyers fairly. We sincerely hope you can appreciate that fact and respect what we try to do to arrange quality events for our Buyers and treat both Sellers and Buyers fairly.

If a reserve is agreed to, the Owner or executor of consigned property may also legally bid on his or her property, but not above the agreed reserve. Bids by the Seller over a reserved price will be ignored. The Owner may not employ a third party to bid unless the Auctioneer is notified and the same rule applied.

In case of a tie bid, the bidding will be re-opened between the two tied bidders only.

The auction crew may be seeing items for the first time and in fairness to them and the Seller, they are permitted to bid on items they are willing to buy personally. They pay for what they buy just like everyone else with no discount. Absentee proxy bidding is accepted on up to 5 items and the name will be provided.

The word sold is not final, sold out is. Please show your number each time you have the winning bid, even if we know it. We accept personal checks, business checks, Visa, Master Card and Discover. If you need to make special arrangements or need extra time, please tell the cashier.

We DO NOT charge a buyer's premium on personal property. All items are sold as is, where is, unless the auctioneer specifically guarantees an item. The new owner assumes all responsibility. All merchandise must be moved from the facility or auction site within 24 hours, unless arrangements are made. Buyer's may remove their items from the building or site during the auction before they pay the cashier.

In case of a dispute, all our auctions are recorded so pay the amount on the clerking ticket. We will review the recording with you later to resolve the question. Most mistakes are made because our number one rule is broken, so please do not converse with or distract the clerk at any time.
